|Other Information:||The Registrar of the RHRA refused to issue a licence to Ms. Elaine Lindo (the "Applicant") who was operating a retirement home known as In Touch Retirement Living at 64 King Street Toronto (Weston). In an appeal of that decision by the Applicant, the Licence Appeal Tribunal on November 12, 2013, upheld the decision of the Registrar to refuse to issue a licence to the Applicant.
On May 15, 2014 the RHRA charged Ms. Lindo with operating a retirement home without a licence, contrary to section 33 of the Retirement Homes Act, 2010 (the "Act"). The Applicant was convicted and sentenced in Provincial Court on March 11, 2015, for operating a retirement home without a licence. Ms Lindo was sentenced to 15 days' imprisonment, a fine of $2,500 and a probation order. The probation order is for a term of two years and prohibits Ms. Lindo from admitting any resident over the age of 65 to her facility and requires regular reporting of resident information and care services to the RHRA for the term of the probation order.
On December 12, 2016, the RHRA charged Ms. Lindo for operating without a licence, contrary to section 33 of the Act and for breach of her Probation Order contrary to section 75 of the Provincial Offences Act, 1990. In addition, in December 2016 the Registrar has ordered Ms. Lindo to immediately take steps to stop operating In Touch as a retirement home, and to pay a $10,000 penalty.
The Registrar issued an Order on July 18, 2017 ordering Ms. Lindo to pay a $10,000 penalty for the continued operation of In Touch as a retirement home, without a licence
